These Terms of Service ("Terms") govern your access to and use of the Engage AI service. The service is provided by AI-ENGAGE LTD, a company registered in England and Wales under company number 17216900, with registered office at 71-75, Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ. "Engage AI" is a trading name of AI-ENGAGE LTD. By creating an account or using the service, you agree to these Terms.

1. The service

Engage AI provides an AI-assisted customer-support platform. The service is provided on an "as is" and "as available" basis. We are an early-stage product and features may change as the product develops.

2. Accounts

You must provide accurate registration information and are responsible for activity under your account and for keeping credentials secure. You must be authorised to bind any organisation you register on behalf of.

3. Acceptable use

You agree not to use the service unlawfully, to infringe others' rights, to attempt to disrupt or reverse-engineer the service, or to upload content you are not entitled to process. You are responsible for the content and knowledge sources you connect.

4. Fees and billing

The service is billed on a usage basis as described on our Pricing page. New accounts receive promotional credit as described there. Prepaid funds and refunds are governed by our Refund Policy.

5. Customer data

You retain all rights to data you submit. We process it to provide the service in accordance with our Privacy Policy.

6. Intellectual property

We and our licensors retain all rights in the service and its underlying technology. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription.

7. AI output

The service uses automated systems that can produce inaccurate output. You are responsible for reviewing and configuring escalation and human review for use cases that require it. We do not warrant that output will be error-free.

8. Availability

We aim to keep the service available but do not guarantee uninterrupted operation. Planned maintenance and incidents may occur. Any service-level commitments must be agreed separately in writing.

9. Termination

You may stop using the service and close your account at any time. We may suspend or terminate access for breach of these Terms or where required by law. Refund treatment on termination is set out in the Refund Policy.

10. Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees paid by you in the three months preceding the claim. We are not liable for indirect or consequential loss. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
